Guidelines
-Please provide clear visual references. High-resolution photographs are best. You can send text or sketches to accompany your photos to let me know what you’re looking for. The more information you give me, the better. References can include: person to be drawn, pose, clothing/armor, backgrounds, items (weapons, instruments, etc.), hairstyle, tattoos.
-Commission slots are limited. I can only take a few commissions at a time. I complete commissions on a first-come, first-served basis. You can claim a slot (when they are available) by filling out my commissions form.
-Prices are based on my anticipated amount of labor. Line art is priced lower than fully rendered portraits, which are priced lower than full-body art, etc. See the Pricing Guide.
-I'm willing to draw: humans/humanoids, nudes, original characters (OCs), fan art, combat/violence, crossovers.
-I will not draw: porn or explicit sexual acts, furry or anthro, logos, copies of other artwork.Payment
-Payment is processed by invoice in US Dollars.
-You secure a commission by paying a deposit (usually 50% of the final price).
-After I review your request and we agree on a final price, I will send you an invoice for the deposit. I’ll start working on your commission as soon as I receive your deposit. Once your work is complete, I’ll send you a final invoice. Once the final invoice is paid, I will send you the final art.
Commissions Terms of Service
Full Terms of Service
This Terms of Service Agreement ("Agreement") is entered into between the Artist and the Client for the commission of an artwork (“Commission”). By commissioning the Artist, the Client agrees to the following terms:1. ENGAGEMENT
Client provides clear and complete requirements and expectations upfront, including reference materials or assets before the Commission begins.
Client grants to the Artist non-exclusive rights to observe and replicate Client’s own character design, reference material and other intellectual property for the use during the Commission.
Client warrants that the character design, reference material and other intellectual property provided to the Artist are legally obtained and authorized for use by the Client.
Client warrants that they have the authority to enter this agreement, be the point of contact, and are solely responsible for decisions and approval during the process.
Artist strives to perform to the best of their ability in good faith and warrants the Commission is 100% original according to the Artist's best knowledge.
Artist may use commercially licensed, copyright-free and/or educational materials, assets and/or tools.
Artist warrants that they will not copy or heavily reference unauthorised materials.
Artist defines scope of work, features, price, deliverables and other details for the project in a proposal in a format according to Artist discretion. The details set forth by the Artist shall be agreed upon by the Client before work begins.
Artist reserves the right to refuse projects or requests based on content, subject, or other reasons. Specific restrictions include but are not limited to: gore, copied styles and/or plagiarism, insensitive depictions of cultures, offensive subject matter.
2. TIMELINE AND PROCESS
Work completion depends on each project and on Artist’s current available schedule. Completion deadline(s) will be agreed upon between Artist and Client beforehand.
Timeline depends on commission type, complexity, and workload.
Artist provides progress updates and seeks Client feedback voluntarily. After Artist has completed sketches and other initial steps, Client may request changes to the Commission. Client may not request changes to final products. See “Revisions” section below.
Final deliverables are provided by the Artist using email, Google Drive or similar file transfer tools, in PSD, PNG, JPG formats as applicable. Any files hosted by the Artist will be available for the Client to download for 1 month.
If there are any delays and adjustments to timeline, the Artist will inform the Client.
Clients must first agree to delays and amendments to timeline exceeding 1 month after the deadline through standard communication channels.
3. REVISIONS
Up to three revisions are allowed per item shown to the Client during the process. Client will be shown sketches to determine if changes should be made.
After line art, only minor revisions are allowed. (i.e. no changing the pose, expression or anything that would require heavily redrawing parts of the drawing which have previously been approved by Client.)
Additional charges for excessive revisions may be required.
Revisions may affect progress and timeline.
Clients may not edit the work after final delivery unless specified in the commission information, project outlines or otherwise approved by the Artist.
4. COMMUNICATION
Ongoing communication and discussion will occur throughout the project, including work in progress, idea generation and collaboration, situational updates, and more.
The primary channel for communication between Artist and Client shall be email, but clients may request other communication channels to be used by Artist at Artist’s discretion.
Artist response time may vary up to two weeks depending on current workload.
The Artist and Client agree to discuss relevant matters concerning the project.
5. RIGHTS & USAGE
By default, Artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to displaying the Commission and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more, exempting when some or all of these rights are transferred to the Client under express agreement or project specifications.
Client may request the Artist to wait until a specific date to share the Commission publicly on websites, social media, portfolios, etc. (i.e. someone’s birthday, Client’s channel launch, etc.)
The Artist may use rejected work in progress and versions for other projects according to their discretion, under the condition that it does not infringe the Client's intellectual property rights and ownership of their likeness, character design, branding, identity design or any such trademarks.
The Artist retains the non-exclusive rights to sell merchandise and prints of the Commission only if Work is fanart from a third party IP (i.e. Baldur’s Gate 3, Arcane, Skyrim, etc.) which doesn’t include any of Client’s original characters.
Artist retains the right to watermark or otherwise designate on the artwork the Artist’s name and year of Commission, unless otherwise agreed with the Client.
6. PERSONAL USE LICENSED WORKS
Clients receive non-transferable usage rights to the Commission for personal use. Refer to “Commercial Use” below for commercial rights.
Personal use means: display on social media accounts for promotional purposes with no direct monetization or sales, such as social media profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels; or any other instances where no monetization of, or of content featuring, the Commission is involved.
Client must not claim the Commission as their own and must credit Artist using their social media tag/username/link at the instance of display of the Commission or permanently on their websites, social media profiles, broadcast channels and so on where possible.
Usage of Commission for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.
7. COMMERCIAL USE LICENSED WORKS
Commercial usage rights are not included in commissions for personal use. Commercial usage rights are covered in a separate contract that must be agreed to by both Artist and Client before Commission begins.
Commercial broadcast rights means usage of Commission on streams, videos, advertisements and other content, or any similar monetized instances; commercial distribution rights means selling or reselling Commission to another party, as a part of any product or merchandising, or on another platform.
Businesses, agencies, groups and other organizations should contact the Artist to discuss arrangements in more detail.
In the case of original design work and assets for the purpose and definition of the Client's brand identity such as character design and more, intellectual property rights of the designs and their likeness are exclusively transferred to the Client for use, production and modification purposes, commercial or personal.
Usage of Commission for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.
8. PAYMENTS & FEES
Client pays 50% of the agreed price as a deposit. An invoice will be sent by Arist to Client for the deposit.
Artist will not begin to work until the first invoice has been paid by Client. In the event that Client takes more than 3 days to send the payment, Artist reserves the right to keep working on other commissions, freelance work, etc.
Prices are in US Dollars only and paid via PayPal or methods as provided by the Artist.
Prices may vary or change depending on complexity, requirements and/or additional requests.
Once Commission has begun or payments have been made, the Client acknowledges the Commission and deliverables are digital and there are no physically shipped goods to receive.
Client agrees that they will not issue chargebacks and the refund policy mentioned below will be followed.
9. CANCELLATION & REFUNDS
If Client requests cancellation, a full refund will be provided as long as Artist hasn’t started working on the initial sketch. A partial refund will be provided based on work completed by Artist, at Artist’s discretion.
No refunds are possible after work begins unless initiated by the Artist. In case of a cancellation requested by Client, the Artist will keep the initial deposit, or the Artist may issue a partial refund based on work completed, at Artist’s discretion.
If Artist cannot complete work or there are delays as detailed above for unforeseen reasons, the Client may be eligible for a full refund. If work done up to this point is accepted and used by the Client, the Artist will provide a partial refund according to the amount of work completed.
10. CONFIDENTIALITY
The Artist and Client acknowledge that information and materials that are provided to either party (including but not limited to personal information, technical information, marketing plans, payment information, or sensitive business information) outside of the development of the Commission, that will not be visible to the public, shall be considered confidential information and shall not be disclosed to any other party without prior written permission from the owner of this confidential information.
11. INDEMNIFICATION
Client indemnifies Artist against claims, losses, damages, and expenses related to Commission usage by the Client, breach by the Client of the Agreement, or third-party claims.
If Client's rights and the terms of this agreement are violated or the Commission is not delivered as agreed, due to Artist negligence, Artist will work to remedy the situation first according to the terms aforementioned and otherwise to the satisfaction of the Client.
12. ACCEPTANCE
Client is an adult and legally able to commit to an agreement or has a legal guardian to make this agreement on their behalf.
Agreement date is upon first inquiry/communication or first transaction.
